1. Agreement to Terms

By accessing or using NECexam ("the Service"), operated by NECexam ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

NECexam is an online study platform that provides plain-language rewrites of the National Electrical Code (NEC) NFPA 70, practice questions, flashcards, exam simulations, and progress tracking tools designed to help electricians prepare for licensing examinations.

NECexam is an independent educational resource and is not affiliated with, endorsed by, or sponsored by the National Fire Protection Association (NFPA) or any state licensing board.

3. Accounts

You must create an account to access certain features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account and to update your information as necessary.

4. Subscriptions and Payments

4.1 Free Tier

We offer limited free access to select NEC articles. No payment is required for the free tier.

4.2 Paid Plans

Paid subscription plans provide full access to all content and features. Subscription fees are billed in advance on a recurring basis (monthly, quarterly, or annually) depending on the plan you select. Lifetime plans are a one-time payment granting perpetual access.

4.3 Billing

All payments are processed through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. You are responsible for providing valid payment information.

4.4 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

4.5 Refunds

We offer refunds on a case-by-case basis within 7 days of purchase. Contact us at the email listed below to request a refund. Lifetime plan purchases are eligible for a refund within 14 days.

5. Acceptable Use

You agree not to:

  • Share, redistribute, or resell any content from the Service
  • Use automated tools, bots, or scrapers to extract content
  • Share your account credentials with others
  • Attempt to circumvent subscription restrictions or access controls
  • Use the Service for any illegal or unauthorized purpose
  • Interfere with or disrupt the Service or its infrastructure

6. Intellectual Property

All content on the Service, including plain-language rewrites, practice questions, explanations, and software, is owned by us or licensed to us and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without written permission.

The National Electrical Code (NEC/NFPA 70) is a copyrighted publication of the National Fire Protection Association. Our plain-language rewrites are original educational interpretations and do not reproduce the official code text.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that our content is error-free or that it constitutes the most current version of the NEC.

Our study materials are educational aids and should not be used as a substitute for the official NEC codebook. We do not guarantee that using our Service will result in passing any licensing examination.

8. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting a notice on the Service or sending an email. Continued use of the Service after changes constitutes acceptance of the updated Terms.

10. Termination

We may suspend or terminate your account at our discretion if you violate these Terms. Upon termination, your right to access the Service ceases immediately. Any provisions that by their nature should survive termination shall survive.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
